Suppressors After October 9, 2026: What Changed

Updated October 29, 2026

Big news, folks: as of October 9, 2026, ATF no longer requires a Form 4, Form 1, tax stamp, or registration for suppressors. In most states, buying a can now works like buying a rifle.

How it happened

  • Jan 1, 2026: The NFA tax on suppressors dropped to $0.
  • Aug 5, 2026: A Texas federal court ruled the registration rules can’t stand without the tax (Silencer Shop Foundation v. ATF).
  • Oct 9, 2026: The DOJ didn’t appeal, and ATF stopped enforcing those rules nationwide.

What still applies

  • A Form 4473 and background check at the dealer.
  • Your state’s law. Suppressors are still banned in CA, DE, HI, IL, MA, NJ, NY, RI, and D.C., and some other states still tie legality to federal registration. Check before you buy.
  • Use caution driving through states that ban suppressors.

It’s not a repeal. The NFA is still law, and Congress, the courts, or a future administration could change course. You can still register voluntarily for $0.

Not legal advice. Check your state’s laws before you buy or build.
